  • FMCSA's New ELP Rule Could Park Your Drivers
    Aug 11 2026
FleetGuard USA FMCSA proposes making English Language Proficiency (ELP) violations an official out-of-service offense for commercial truck drivers. --- - FMCSA published a proposed rulemaking that would formally classify ELP non-compliance as an out-of-service (OOS) violation, removing non-compliant drivers from the road immediately - The proposal aligns federal rules with CVSA's existing OOS criteria, which added ELP violations effective June 25, 2025 - Current federal regulations already require CDL drivers to read, speak, and understand English well enough to communicate with the public, read signs, and complete reports — this rule adds enforcement teeth - A limited exception exists for drivers operating exclusively within designated U.S.-Mexico border commercial zones - FMCSA estimates approximately 9,000 drivers will be placed OOS annually in border regions, costing motor carriers an estimated $14.4 million per year in freight delays and replacement driver costs - The public comment window is open for 60 days after official Federal Register publication --- For fleet managers and owner-operators in the Southern US — especially those running loads near the Texas-Mexico border corridor — this rule has direct operational and financial implications. An OOS violation means a driver is sidelined on the spot, leaving freight stranded and timelines blown, which can trigger cargo claims and liability exposure your insurance coverage needs to be built for. FleetGuard clients should also be aware that driver qualification violations like ELP can affect your safety scores, CSA ratings, and ultimately your insurance premiums — making driver vetting and documentation more important than ever.
