Episode 3: The First Expert Call - Building an Ethical, Efficient Medical-Legal Collaboration.
Most expert engagements that go wrong were set up wrong on the first call. In this episode I walk through how attorneys and medical experts should run that first conversation: defining the role before discussing the merits, matching the assignment to the expert's actual qualifications, raising conflicts and compensation up front, presenting the case without announcing the answer, being honest about missing records, and putting the agreement in writing. Plus a real example of an expert who re-reviewed a case after the theory changed, never discussed the extra hours, and is still chasing that invoice.
Before your next first call, write down five things: the role, the clinical questions, the records, the boundaries, and the next decision point.
This is educational guidance, not legal advice. Engagement, privilege and disclosure rules vary by jurisdiction; confirm the details for your matter with qualified counsel.
